Medical Power of Attorney
The Enduring Power of Attorney (Medical Treatment) (medical power of attorney) in Victoria has been replaced under new laws that I introduced here. We now have an Appointment of a Medical Treatment Decisions Maker instead.
Along with a change in the term of the person who can make medical decisions for me, if you cannot make them for yourself, there have been other changes.
Now, whomever you appoint does not have to act ‘in your best interests’; rather, they have to act with your values and wishes in mind.
There’s also been the introduction of a binding Advanced Healthcare Directive which you can complete with a medical professional, so that your Medical Treatment Decisions Maker, as well as all medical professionals, are bound by your wishes.
